Terms of Service

1. This agreement

Zavil is run by Nodeflow Labs, a sole proprietorship owned by Amit Kumar Deenanath Yadav ("Zavil", "we", "us"), registered at Rupa Devi Pada No. 2, Indira Nagar, near Jost Building, opposite Laxmi Medical, Thane West, Maharashtra 400604, India. These terms apply when you create a Zavil account or use Zavil as a creator ("you"). By creating an account you agree to them, to our Privacy Policy and to our Acceptable Use Policy.

Zavil gives creators a page (for example zavil.space/yourname), short links, offers such as guides, courses, calls and live events, email newsletters and sequences, Instagram AutoDMs and a community. Guides are free; courses, calls and live events can also be sold on your own checkout (see Payments and sales). People who visit your page or sign up for your offers ("fans") use Zavil under our Privacy Policy; these terms are between Zavil and creators.

2. Your account

• You must be at least 18, or the age of majority where you live, and able to enter a binding contract.
• Give accurate information and keep it up to date. One person or business per account.
• Keep your login safe. You're responsible for what happens under your account. If you think someone else has access, tell us straight away at support@nodeflowlabs.com.
• If you use Zavil for a business, you confirm you can accept these terms on its behalf.

3. Plans and billing

Zavil has three plans, billed monthly in US dollars:

• Dodo Payments is the merchant of record. Paid plans are sold and billed by Dodo Payments, which processes your payment, charges any sales tax, VAT or GST that applies, and issues your invoice. Your purchase is also subject to Dodo Payments' terms. We never see or store your full card details.
• Paid plans renew automatically every month until you cancel. Each renewal is charged at the start of the period.
• Switching between Creator and Pro takes effect straight away, and Dodo Payments charges or credits the prorated difference. Moving to Free happens at the end of the current billing period (see cancelling below).
• If a payment fails, Dodo Payments may retry it. If it still can't be collected, the subscription ends and your account moves to the Free plan. Anything over the Free plan's limits is paused, not deleted.
• Plan limits (contacts, AutoDMs, community members, AI drafts and so on) are listed on our pricing page and in your account. We may change prices or limits with at least 30 days' notice by email. Price changes apply from your next billing period after the notice.

4. Cancelling and refunds

• You can cancel a paid plan any time in Settings → Plan. You keep your paid features until the end of the billing period you've already paid for; then your account moves to the Free plan. We don't charge you again after you cancel.
• Payments aren't refunded for partly used billing periods, except where the law requires it or where we decide to in a particular case.
• Moving to the Free plan doesn't delete your data. To delete your account, see Data deletion.

5. Payments and sales

Zavil doesn't process payments between you and your fans, and you may not use Zavil itself to collect payment details from them. You can sell a course, a 1:1 call or a live event by setting a price and linking your own checkout; buyers then get in, book their call or take their seat with the private access link you give them. You can also link to your own checkout or website from your page or your emails. These sales are between you, your fans and the checkout you use. Zavil isn't a party to them and takes no cut. You're responsible for what you sell, refunds, and taxes on your sales.

6. Your content and your audience

Your content

You own what you upload or write on Zavil: your page, offers, emails, posts and files. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and send that content only as needed to run Zavil for you and your fans (for example, showing your page, delivering your emails and making backups). This licence ends when you delete the content or your account, apart from copies in backups that are deleted on their normal schedule.

You confirm you have the rights to everything you put on Zavil and that it follows our Acceptable Use Policy.

Your audience

The contacts who sign up on your page are your audience. You can export them at any time. For that data you decide what's collected and how it's used, and Zavil processes it on your behalf, as described in our Privacy Policy. You're responsible for:

• having a lawful basis, such as consent, to email the people on your list;
• following anti-spam and privacy laws that apply to you, such as CAN-SPAM, GDPR and India's DPDP Act;
• honouring unsubscribes (Zavil adds an unsubscribe link to every marketing email and handles it for you);
• only importing contacts who agreed to hear from you.

We don't sell your audience's data, and we don't email your audience for our own marketing.

7. Connected services

Some features work by connecting accounts you hold elsewhere: Instagram (Meta) for AutoDMs, Google for sign-in, Google Calendar and Google Meet, and Zoom for call links. When you connect one, you authorise us to access it as described when you connect and in our Privacy Policy. Your use of those services is governed by their own terms, including Meta's Platform Terms and Instagram's Community Guidelines. Those providers can change or withdraw access at any time, and we aren't responsible for their services. You can disconnect any of them in Zavil at any time.

8. AI writing

Zavil can draft text for you, such as emails, DMs and offer descriptions, using an AI model. Drafts can be wrong, incomplete or similar to text written for others. Review them before you publish or send, because you're responsible for what goes out under your name. Your monthly AI draft allowance depends on your plan.

9. Acceptable use

You must follow our Acceptable Use Policy. In short: no spam, nothing illegal, no impersonation, and no misuse of AutoDM or anyone else's accounts. You may not interfere with Zavil, try to get around its limits or security, scrape it, or resell it without our written permission.

10. Suspension and termination

• You can stop using Zavil and delete your account at any time.
• We may suspend or close your account, or remove content, if you break these terms or the Acceptable Use Policy, if the law requires it, or if your use puts fans, other creators, Zavil or our providers at risk. Where it's reasonable we'll tell you first and give you a chance to fix the problem.
• If we close your account without cause, we'll give you at least 30 days' notice to export your data and refund any prepaid period you can no longer use.
• Sections 5 to 8 and 11 to 15 survive the end of this agreement.

11. Disclaimers

We work hard to keep Zavil running and your data safe, but Zavil is provided "as is" and "as available". To the extent the law allows, we don't promise that it will be uninterrupted, error-free or meet every need, or that any number of followers will become subscribers. We're not responsible for outages or changes at the third-party services Zavil connects to, such as Instagram, Google, Zoom or email inbox providers.

12. Limitation of liability

To the extent the law allows:

• neither you nor Zavil is liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, followers, goodwill or data, even if warned they might happen; and
• Zavil's total liability for all claims about Zavil or these terms is limited to the greater of the amount you paid Zavil in the 12 months before the claim arose, or US$100.

Nothing in these terms limits liability that can't be limited by law, such as for fraud, or rights you have as a consumer that can't be waived.

13. Indemnity

You agree to cover Zavil's reasonable losses and costs (including legal fees) from third-party claims arising from your content, the way you use your audience's data, or your breach of these terms or the law.

14. Changes to these terms

We may update these terms as Zavil changes. For material changes we'll email you at least 30 days before they take effect. If you keep using Zavil after that, the new terms apply; if you don't agree, you can cancel and delete your account before then.

15. Governing law and disputes

These terms are governed by the laws of India. The courts at Thane, Maharashtra, India have exclusive jurisdiction, except that either of us may seek urgent relief in any court that has jurisdiction. If you're a consumer, you also keep any rights you have under the laws of the country where you live. Before going to court, please email us so we can try to sort it out together.
